Made By Photo®, from RPI Print, Inc., is a platform for designing and ordering custom and professional-quality prints, framed art, fine art prints, gifts and other products.  This Made By Photo Privacy Policy (Privacy Policy” or Policy”) describes how we and our affiliates and subsidiaries (collectively herein"Made By Photo", "us," “our,” or "we") collect, use, disclosure and otherwise process the personal information described in this Policy.

Users of the Made By Photo website, www.madebyphoto.com, and online services, and the features and services provided by us therein, including any design and content-creation tools, and any downloadable software or applications provideby Made By Photo that display or include a link to this Policy; 

  • Orders of Made By Photo’s products, including photobooks, albums and other digital and physical products sold or provided by Made By Photo; 

  • Subscribers to Made By Photo’s newsletter and participants in Made By Photo rewards programs, contests, promotions, surveys, research, sweepstakes, and other events sponsored by us;  

  • Prospective customers, such as customers of our sister brands and affiliated companies who may be interested in Made By Photo’s products and services; and  

  • Individuals that communicate with us or otherwise engage with us related to Made By Photo’s products and services, online or offline. 

Not Covered by this Policy. This Policy does not apply to job applicants and candidates who apply for employment with us, or to employees and non-employee workers in the context of our working relationship with them. This Policy also does not apply to any third-party websites, services, or products maintained by other companies, which are linked to from our site or other online services.

Made By Photo collects personal information directly from you, automatically related to the use of our website and other online services or other interactions with us, and in some cases, from third-parties 

Personal Information We Collect from YouThe personal information we collect about you varies depending upon the circumstances.  Generally, we collect the following information:  

  • Registration and Profile InformationYou can visit our website and use certain features and services without registering. However, to create an account with us and use certain features and services, you must provide us with certain personal information such as your name, password, and email address. We may also ask you or allow you to submit certain optional information, such as information about your preferences and additional contact information.  

  • Purchases and PaymentInformationWhen you purchase products or services on the website, we collect personal information necessary to complete the transaction, including payment information such as name, credit card information, payment account details, billing information, and shipping information. We also collect personal information of your gift recipients, such as name, email and address, in order to fulfill purchase orders if you provide us with this information.  

  • Marketing, Contests, and PromotionsWhen you subscribe to our newsletter, we collect your email address and other contact information to provide you with promotional information about our products and services, and those of our sister brands and affiliated companies.If you participate in sweepstakes, contests and promotions that we offer, we collect your name, age, email address, and other registration information related to contests, sweepstakes and promotions 

  • Communications and InteractionsWhen you contact us to submit comments, questions or feedback to use, we collect your name, email address and your comment, question or feedback to answer your request, questions or concerns. When you email, call, or otherwise communicate with us and with members of our team, we collect and maintain a record of your contact details, communications and our responses. We also maintain records of communications and information that you post on our website, submit through our website and online services (e.g., through our chat feature), as well as on our social media channels, and information you provide to us related to any customer support requests. 

  • Events and Other RequestsWhen you participate in one of our surveys or questionnaires, we may collect additional profile information such as demographic information and other information.If you participate in our events as well as other requests that you submit to us related to our products and services. For example, if you register for or attend an event that we host or sponsor, we may collect information related to your registration for and participation in such event.  When you fill out a ‘Contact Us’ form, signup for our mailing lists, or otherwise request information from us, we collect and maintain records of your requests. 

Personal Information Automatically Collected About Your Usage and ActivitiesWe collect personal information about how you use our website, and other online services and interact with us and others, such as information we collect automatically (e.g., using cookies and pixel tags), as well as information we derive about you and your use and interactions. Such personal information includes 

  • Device and Browsing InformationWe use cookies, log files, pixel tags, and other tracking technologies to automatically collect personal information when users access or use website, and other online services, such asIP address, general location information (and in some instances, device geolocation information), browser type, domain names, access times, pages views, date/time stamps, operating system, language, mouse clicks, mouse movements, scrolling activity, device type, unique ID, Internet service provider, referring and exiting URLs, and similar device and usage information.   • Activities and UsageWe also collect activity information related to your use of the our website, and other online services, such as information about the links clicked, searches, features used, items viewed, time spent, files uploaded, and products and items you view and items you add to your cart. We may use analytics providers and technologies, including cookies and similar tools, to collect this information.  

Personal Information We Collect and Receive from Third PartiesWe may collect and receive personal information about you from third parties, such as affiliatesbusiness partners and co-branded or private-labeled websites ("Partner Companies"), advertising networks, data analytics providers, social networks, Internet service providers, operating systems and platforms, government entities, public databases, data brokers, and vendors and service providers who provide services on our behalf.  

  1. DISCLOSURE AND SHARING OF PERSONAL INFORMATION 

We may disclose your personal information as follows, and we will obtain your consent to do so where required by applicable law: 

  • Vendors and Service ProvidersWe may engage vendors, agents, service providers, and affiliated entities to provide services on our behalf, such as support for our internal operations of our websites, online stores (including payment processors), products, and online services (e.g., forum operations and technical support processing) as well as shipping and distribution processors, account inquiries, support services, data storage, marketing analytics, and other servicesIn providing these services, they may access, receive, maintain, or otherwise process personal information on our behalf. Our contracts with these services providers do not permit use of your personal information for their own marketing and other purposes.  

  • Affiliates and SubsidiariesWe may disclose your personal information to our affiliates or subsidiaries. 

  • Advertising and Analytics Services. We work with advertising and analytics companies that provide advertising, campaign measurement, online and mobile analytics, and related services to us (with your consent, where required by applicable laws) and to others. They may use the information we provide or make available to help us better reach individuals with relevant ads and to measure and improve our ad campaigns, or to better understand how individuals interact with our website, and online services. In addition, these advertising and analytics companies may combine the information collected from us and our services with information collected about you by them and from third-party sites, apps and services, in order to make inferences about you and your interests, to better tailor advertising and content to you across multiple sites, apps, and services, and to collect associated metrics. 

Partner CompaniesWe may enter into co-branding or co-promotional agreements with Partner Companies pursuant to which we provide the Partner Companies with a URL and a customer registration page co-branded with, or private labeled by, the Partner Companies, and the Partner Companies distributes and promotes the URL to its customers. A Partner Company may have access to certain personal information that we collect from their customers, and they may share customer information with us. As a result, if you register through a Partner Company, we may provide your personal information to the Partner Companyas needed to provide services to youPlease note, however, that we do not control the privacy practices of these Partner Companies. 

  • Legal Obligations. We may also disclose your personal information if we believe we are required to do so by law, or that doing so is reasonably necessary to comply with legal processes, including when we believe necessary or appropriate to disclose personal information to law enforcement or other governmental or regulatory authorities or the courts (in any relevant jurisdiction worldwide). In addition, we may disclose the names of sweepstakes and contests winners, in accordance with applicable law.  

  • Security and Protection of Rights. We may also disclose your personal information where we believe doing so is necessary to protect us, our website, and other online services, and our business operations; to prevent and detect fraud, unauthorized activities and access, and other misuse; to investigate, prevent or take action regarding actual or suspected illegal activities or fraud, situations involving potential threats to the safety or legal rights of Made By Photo or any person or third party, or violations of our Terms and Conditions; to regularly exercise our rights in judicial, administrative or arbitration proceedings; to respond to any claims against us; and to protect the rights, property, or personal safety of Made By Photo, our customers, or the public. 

  • Corporate Transactions. In addition, your personal information may be disclosed as part of any proposed or actual merger, sale, and transfer of Made By Photo assets, acquisition, bankruptcy, or similar event. We may also disclose certain personal information as necessary prior to the completion of such a transaction, such as to lenders, auditors, and third-party advisors, including attorneys and consultants, as part of due diligence or as necessary to plan for the transfer. 

Aggregate and Non-Identifiable Information. Notwithstanding anything else in this Policy, we may share use, disclose, and otherwise process aggregate and de-identified information related to our business and Made By Photo products and services with third parties for research, marketing, analytics and other purposes. Where we use, disclose or process de-identified data we will maintain and use the information in de-identified form and not to attempt to reidentify the information, except pursuant to applicable privacy laws. 

  1. COOKIES, TARGETING, AND ANALYTICS 

We and our third-party providers use cookies, clear GIFs/pixel tags, JavaScript, local storage, log files, and other mechanisms to automatically collect and record information about your browsing activities and use of our products and servicesWe may combine this "activity information" with other personal information we collect about you. Generally, we use this activity information to understand how our website, and other online services are used, track bugs and errors, assess, secure, protect, optimize and improve the performance of our servicesto prevent fraud and protect our business, as well as for targeted marketing and advertising, and for analytics purposes.For information on how to exercise your cookies, personalization and analytics choices, please see the “Third-Party Advertising” section below. 

Cookies.Cookies are small files with a unique identifier that are transferred to your browser through our websites. They allow us to remember you when you are logged in to our website and other online serviceshelp us understand how you navigate through and use our website and other online services, and allow us to display personalized content and targeted ads (including on third-party sites and applications).  

Pixel Tags. Pixel tags (sometime called web beacons or clear GIFs) are tiny graphics with a unique identifier, similar in function to cookies. While cookies are stored locally on your device, pixel tags are embedded invisibly within web pages and online content. We may use these, in connection with our website and other online services to, among other things, track the activities of users, help us manage content and compile usage statistics. We may also use these in HTML e-mails we send, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded. 

Log Files. We collect certain activity information from log files. Log file information is automatically collected by our servers when you access our website. We record certain information from these log files, including web requests, IP address, browser type and version, language information, referring and exiting URLs, links clicked, pages viewed and other similar information. 

Analytics ToolsWe use third party tools, such as Google Analytics, which are operated by third party companies, to evaluate our website and online services. These third-party analytics companies may collect usage data (using cookies, pixels and similar tools) about our website and other online services in order to provide us with reports and metrics that help us evaluate usage of our website and other online services, improve our Sites, and enhance performance and user experiences. Do-Not-Track Signals. Please note that our websites do not recognize or respond to any signal which your browser might transmit through the so-called "Do Not Track" feature your browser might have. However, you can set your preferences for cookies on our websites as discussed below.

We work with third parties, such as third-party ad networks, channel partners, analytics and measurement services and others (“third-party ad companies”) to display advertising within our website and other online services, as well as to manage our advertising on third-party sites, and online services. We and these third-party ad companies may use cookies, pixels tags, and other tools share certain information with these third-party ad companies, and we and them may use cookies, pixels tags, and other tools (which we may refer to collectively as "targeting cookies") to collect activity information within our website and other online services (as well as on third-party sites and services), as well as IP address, location information, unique ID, cookie and advertising IDs, and other identifiers, as well as browsing information. We and these third-party ad companies use this information to provide you more relevant ads and content within our website and other online services and on third-party sites and apps, and to evaluate the success of such ads and content.

Industry Ad Choice ProgramsYou can control how participating third-party ad companies use the information that they collect about your visits to our website  and those of third parties, in order to display more relevant targeted advertising to you. Marketing Communications. You may opt out of marketing and promotional communications you receive from us by using the unsubscribe option provided in each marketing communication we send you. Even if you opt out of marketing and promotional communication emails from us, we may still send you transactional and other non-promotional emails. 

Cookies PreferencesAs described in the Cookies, Targeting and Analytics” and “Third-Party Advertising” sections above, you can manage your preferences for cookies (including targeting cookies) on our website by adjusting your cookie settings or other preferences.

Our website and other online services may contain links to third-party sites that are not owned or controlled by us. We are not responsible for the collection and use of your information by these third-party sites. We recommend that you read the privacy notice of the website to which you link before you submit any personal information. 

In addition, our website and other online services may include or incorporate third-party features (e.g., widgets, buttons, and plugins), which are operated by third-party platforms and networks. These features are hosted by the respective third-party operator even though they appear on our website and other online services, and the third party may collect your IP address, URL, date and time stamp, browser details and the like, subject to their own privacy policies.

We will retain your personal information as long as reasonably necessary for purposes for which the personal information was collected and is used by us, as stated in this Policy. Further, to the extent permitted by applicable law, we will retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, maintain appropriate business records, and enforce our agreements.

Made By Photo is not directed to children, and we do not knowingly collect personal information of children under the age of 13. If we discover that hawse have collected personal information from a child under the age of 13, we will take steps to promptly delete such personal information from our records. If you are parent or legal guardian, and believe that your child has provided us with their personal information, you may notify us at support@mdby.com

We have implemented safeguards that are intended to protect the personal data we collect. Please be aware that despite our efforts, no data security measures can guarantee security. Made By Photo cannot and does not guarantee that unauthorized access, hacking, data loss, or other breaches will never occur.

While we do not disclose personal information to third parties in exchange for monetary compensation, we may “sell” or “share” (as defined by the CCPA) Identifiers, Customer Records, Commercial Information, and Usage Data to third-party advertising networks, analytics providers, and social networks. We do not sell or share sensitive personal information, nor do we sell or share any personal information about individuals who we know are under sixteen (16) years old.

California Residents' RightsCalifornia residents have the right to receive certain information about how their personal information is used and disclosed and to not be discriminated against for exercising their privacy rights under the CCPA.  The CCPA also grants California residents the following rights (subject to certain limitations): 

  • Opt-Out of Sales and Sharing. The right to opt-out of our sale and sharing of their personal information. 

  • Delete. Subject to certain exceptions, the right to request deletion of their personal information that we have collected about them. 

  • Know/Access. The right to request and, subject to certain exemptions, receive a copy of the specific pieces of personal information that we have collected about them and to have this delivered either (a) by mail or (b) electronically in a portable and, to the extent technically feasible, readily useable format that allows the individual to transmit this information to another entity without hindrance. California residents also have the right to request that we provide them certain information about how we have handled their personal information, including the:

When you submit a request to know, to delete or to correct we will take steps to verify your request by matching the information provided by you with the information we have in our records. To verify your request, we will request that you provide us with your name, email and contact details and to confirm your email address. In some cases, we may request additional information in order to verify your request or where necessary to process your request.  

Authorized agents may initiate a request on behalf of another individual by contacting us in writing at the contact information set forth above. Authorized agents will be required to provide proof of their authorization and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent. We will respond to verifiable requests received from California residents as required by law. If we are unable to adequately verify a request, we will notify the requestor. 

Requests to Opt-Out of Sales and Sharing. California residents may submit requests to opt out of “sales” and “sharing” (e.g., targeted advertising) of their personal information by:

Rights Under California's Shine-the-Light LawUnder California’s “Shine the Light” law (Cal. Civ.
